1. Service Description
Auditable.tax ("we", "us", "our") provides an electronic FBAR (FinCEN Form 114) filing platform. We prepare, validate, and transmit your filing data to the Financial Crimes Enforcement Network (FinCEN) via the BSA E-Filing Secure Direct Transfer Mode (SDTM) protocol.
2. Not Affiliated with FinCEN
Auditable.tax is a private filing service. We are not affiliated with, endorsed by, or part of the Financial Crimes Enforcement Network (FinCEN) or the U.S. Department of the Treasury.
3. Your Responsibilities
- You are responsible for the accuracy and completeness of all information you provide
- You must provide truthful information on your FBAR filing (18 U.S.C. § 1001)
- You must review and approve your filing before submission
- You must retain your Form 114a authorization for 5 years
- You must not use the service for any unlawful purpose
4. E-Signature & Form 114a Authorization
By typing your name and checking the authorization checkbox, you provide an electronic signature that constitutes a valid signature under the Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. § 7001 et seq.). Your typed name, IP address, and timestamp serve as your electronic signature. You authorize Auditable.tax to sign and file your FBAR on your behalf as your third-party preparer pursuant to FinCEN Form 114a.
5. Pricing & Payment
- Solo: $39 per filing (up to 5 accounts)
- Expat: $89 per filing (unlimited accounts)
- Pro: $199 per filing (bulk import, priority support)
- Preparer: $200/year + $25 per client filing
- Catch-Up: $750 (6-year delinquent FBAR package)
Payment is processed via Pabbly Payment Gateway. Prices are in USD. Refunds are available within 30 days of purchase if no filing has been submitted.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee:
- That your filing will be accepted by FinCEN (acceptance is at FinCEN's discretion)
- That use of our service will prevent penalties, audits, or enforcement actions
- That the service will be uninterrupted or error-free
- Specific audit outcomes or compliance results
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC FILING THAT GAVE RISE TO THE CLAIM. We are not liable for:
- Penalties imposed by FinCEN or the IRS resulting from inaccurate information you provided
- Delays caused by FinCEN system outages or maintenance
- Loss of data caused by factors beyond our reasonable control
8. Data Protection (GDPR)
We process your personal data in accordance with our Privacy Policy. By using our service, you consent to the processing of your personal data for the purposes described therein. If you are an EU data subject, you have the rights outlined in our Privacy Policy including access, rectification, erasure, portability, and objection.
9. Account Termination
You may delete your account at any time. Upon deletion, we will remove your personal data within 30 days, subject to FinCEN recordkeeping requirements which may require us to retain certain filing records for the mandatory retention period. Filed data that has been submitted to FinCEN cannot be recalled.
10. Governing Law
These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the state or federal courts located in Orange County, Florida.
